Passenger Transportation Provider Terms Of Service
Insurance and Indemnification
Each Operator must obtain and maintain Commercial Automobile Liability Insurance in the minimum amounts as follows:
(a) for Limousine, Livery and Van Operators (seating capacity of 15 passengers or less) One Million Five Hundred Thousand Dollars ($1,500,000.00) ; combined single limit (each accident) and
(b) for Motor Bus Operators (seating capacity of 16 passengers or more)
Five Million Dollars ($5,000,000.00). combined single limit (each accident) for bodily injury and property damage including Excess / Umbrella Liability. The MCCA will be named as "Additional Insured".
Annually, and in advance of each engagement by the Authority, covering the period of such engagement, Operators must submit a certificate of insurance obtained from their insurance broker, which should be typed, bear the insurance broker's stamp, be signed by an authorized individual and name the Massachusetts Convention Center Authority as additional insured and as the certificate holder as follows; Massachusetts Convention Center Authority, 415 Summer St. Boston, MA 02210, Attn: Transportation Department

All Operators legally required to carry Worker's Compensation Insurance, shall submit a certificate of such insurance, bearing insurance broker's stamp and signed by an authorized individual as proof of such coverage, otherwise Operator shall submit an affidavit, form 153, attesting to the fact that Operator is not required to carry worker's Compensation Insurance.
The Operator, at its sole cost and expense, shall indemnify defend and hold harmless the MCCA, its members, officers, agents and employees from and against all claim, causes of action, suits, losses, damages (including death) and expenses (including attorney's fees, expert's fees, disbursements and any and all other costs of investigation and litigation) based upon or arising directly or indirectly out of any act, or omission or activity of Operator, it's contractors, their employees, agents, customers or anyone claiming by or through the Operator.
It will be the right of the MCCA, at their sole discretion, to terminate the privileges of any Operator, Operator's employee, contractor or Vehicle for casue or for no cause from providing service on the Authority's property.
The MCCA reserves the right to (with reasonable notice in the circumstances, but with no notice in the case of an emergency) visit an Operator's facility and review their programs, vehicles or facilities to ensure compliance with the above requirements, and those attested to in the application.
